Terms of Service for OnTheWay LLC

Welcome to OnTheWay. These Terms of Service ("Terms") govern your access to and use of the OnTheWay mobile application, website, and related services (collectively, the "Service") operated by OnTheWay LLC ("OnTheWay," "we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms.
1. Description of Service
OnTheWay is a technology platform that connects riders with independent drivers for transportation services. OnTheWay does not provide transportation services directly and is not a transportation carrier.
Drivers are independent contractors and are not employees of OnTheWay LLC.
2. Eligibility
To use the Service, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding agreement
- Provide accurate and complete registration information
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
You agree to notify us immediately of any unauthorized use of your account.
4. Ride Requests and Services
- Riders may request transportation services through the app
- Drivers may accept or decline ride requests
- Estimated arrival times and pricing are subject to change based on availability, traffic, and other factors
OnTheWay does not guarantee:
- Driver availability
- Exact pickup or drop-off times
5. Payments and Fees
- All payments are processed through secure third-party payment providers
- By requesting a ride, you agree to pay all applicable charges
- Prices may include base fare, distance-based charges, time-based charges, and applicable fees
Cancellations
- Cancellation fees may apply if a ride is canceled after a driver has accepted the request
Refunds
- Refunds are issued at the sole discretion of OnTheWay and may take 3–5 business days to process
6. User Conduct
You agree not to:
- Use the Service for unlawful purposes
- Harass, abuse, or harm drivers or other users
- Provide false information
- Interfere with the operation of the platform
OnTheWay reserves the right to suspend or terminate accounts that violate these Terms.
7. Driver Conduct
Drivers agree to:
- Maintain valid licensing and insurance
- Operate vehicles safely and lawfully
- Provide respectful and professional service
OnTheWay is not responsible for the actions or conduct of independent drivers.
8. Safety and Liability
OnTheWay is a technology platform and does not assume responsibility for:
- The conduct of drivers or riders
- Accidents, injuries, or damages occurring during rides
To the fullest extent permitted by law, OnTheWay disclaims all liability arising from the use of the Service.
9. Limitation of Liability
To the maximum extent permitted by law, OnTheWay LLC shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
Your use of the Service is at your own risk.
10. Account Termination
We reserve the right to:
- Suspend or terminate your account at any time for violations of these Terms
- Remove access to the Service without prior notice
You may delete your account at any time through the app.
11. Intellectual Property
All content, trademarks, and technology within the Service are owned by or licensed to OnTheWay LLC.
You may not copy, modify, or distribute any part of the Service without permission.
12. Privacy
Your use of the Service is also governed by our Privacy Policy.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by the laws of the State of Ohio, United States.
